YCRE Web Design

Terms, Policy and Agreements

Articles:
Search engines love articles. Content is important. For your benefit (and only if you want) I will provide four article pages included in your fee. If you want more than four article pages there will be additional fees.

Colors:
A word about colors. Choosing two colors (not including black and white) doesn't mean you can't have an image or graphic that has gradations of color in it. Most graphics are well color-coordinated and will play well in the two-color scheme.

Fees:
Downpayments are non-refundable and are required before any work is begun..  The balance is due upon mutual agreement between the customer and myself once work is completed.

Legal Agreement:

The agreement will consist of an email that the customer will send to me - the creator of YCRE Web Design.  In it, the customer will state he or she has read all the terms, pricing, fees and provisions pertaining to YCRE Web Design.

The balance of the fee doesn't have to be paid until after the page is finished AND the customer likes the page. If the customer likes the work, then we will proceed with the transaction. If he or she doesn't completely like it, or has suggestions, we'll work from there. BUT...

If the customer likes the time and work I've invested, then the balance of the per-page creation fee PLUS the first month's maintenance fee is due immediately. After that, the monthly maintenance fee is to be paid one month at a time, unless the customer wants to pay more of it up front (It is recommended that the buyer pay one year's worth maintenance fee along with the balance.  This indicates the buyer is sincere). The monthly maintenance fee is due the first day of each month, regardless of the success or failure of the customer's business. Any pre-paid maintenance fee cannot be used as payment for future monthly maintenance fees unless previously and mutually agreed upon.  A mutual agreement will be indicated by an email.  If a payment date is missed or payment is late, the client/customer will be notified. If payment isn't RECEIVED within FIVE days after notice is given, or if client/customer doesn't respond, the site will be taken down from the Internet.

Internet Contracts:
For information about whether an email or fax can constitute a legally-binding contract, go to: Email and Fax Contracts.

While this may sound stringent, you should know that business is business. The customer may wish to have changes made to the page, let it continue as is, or cancel it completely.

What This Offer is Not:
Simple web pages are not a database. By nature, a database involves programming that isn't covered under the general heading of web site creation. If you want a database where you can accumulate, collate and manage data, indicate so and we'll talk.

Also, there is no guarantee that a webpage will be successful. What I guarantee is that the work that is put into the creation of the webpage will be of the highest quality.

Note:
Pages/sites that include nudity or anything of a pornographic nature won't be created.

Theft of my work:
This is the part I really don't like but my attorney said it should be included.
I'm an idealist. I'm also a realist. It's very possible a client/customer will take the code and run. Life is like that. You should know, however, that there are only a finite number of keywords underwhich a web page is listed and any webpage is easy enough to find. Enough said.

Payments may be made through:
1) PayPal, or
2) U.S. Postal Money Order, or
3) Personal Check: A personal check will have to clear BEFORE I release the site onto the web. If the check bounces, I will contact the client/customer and we will try the transaction one more time. If the check bounces a second time, I keep any per-page creation fees and monthly maintenance fees paid, after which I will say goodbye to the customer.
